58.5 Substantially affect the rights of the parties

For the purposes of the court’s enquiry as to whether the determination of the relevant question of law ‘will substantially affect the rights of one or more of the parties’1, the relevant rights are those at issue in the arbitration2. An error of law that, if corrected, would not have significantly altered the outcome of the arbitration, will not suffice3, and if the error of law led to no consequences on the facts, the appeal will be dismissed4.
