58.4 Availability of appeal

Either the agreement of all the other parties to the proceedings1 or the permission of the court2, is first required before the court will hear an appeal on a question of law. Permission to appeal will only be granted in very limited circumstances3, where the court is satisfied that4:

  1. 58.4.1

        the determination of the question will substantially affect the rights of one or more of the parties5;

  2. 58.4.2

        the question is one which the tribunal was asked to determine;

  3. 58.4.3

        on the basis of the findings of fact in the award, either:
