58.10 Remedies

Upon upholding an appeal under the Arbitration Act 1996 Section 69, the court may confirm, vary or set aside the award or remit it to the tribunal for reconsideration1. The court will not set aside an award unless it is satisfied that it would be inappropriate to remit the matter in question to the tribunal for reconsideration2. Where an award is partially remitted to the tribunal, the part that has not been remitted remains valid and enforceable3.
