58 Appeal on a question of law

58.1 Overview of appeal procedure

Under the Arbitration Act 1996 Section 69, a party may, upon notice to the other parties and to the tribunal, appeal to the court on a question of law arising out of an award made in the proceedings1. Appeals against cost awards2 and interim awards3 may be made under this section.

Section 69 is non-mandatory: the parties may exclude any right of appeal under it by agreement4. Such an agreement may be included in the arbitration agreement or incorporated by reference
