47 Interim injunctive relief

The power to grant interim injunctive relief pursuant to the Arbitration Act 1996 Section 44(2)(e) is the most widely used power under Section 44(2). When deciding whether to grant such relief, the court will follow the same approach as under the Senior Courts Act 1981 Section 371.

In circumstances where Section 44 of the 1996 Act applies, the courts will not utilise their wider powers under Section 37 of the 1981 Act so as to bypass the statutory limitations contained in Section 44(3)–(5) of the 1996 Act2. If an arbitration is already on foot and a remedy
