32 Arbitrators’ general duty

The Arbitration Act 1996 Section 33 covers the duties imposed on, and powers available to, tribunals under the Arbitration Act 1996 and the provisions of the Act relating to the conduct of the proceedings. The tribunal’s general duty in the discharge of its mandate is to1:

  1. 32.1

        act fairly and impartially as between the parties, giving each party a reasonable opportunity of putting its case and dealing with that of its opponent; and

  2. 32.2

        adopt procedures suitable to the circumstances of the particular case, avoiding unnecessary delay or expense, so as to provide a
