108 Nature and uses of expert determination

Parties may agree to refer their dispute for determination by an independent expert chosen for his expertise in the subject matter of the dispute1. Expert determination is a useful process in appropriate cases, particularly those involving valuations or technical issues which are better suited to resolution by a person skilled in the relevant subject matter rather than a person acting judicially to assess the weight of evidence and submissions presented by the parties.
