103 Determining the mediation and recording agreements

103.1 The end of the mediation process

The point at which the mediation is determined will either be stipulated in the parties’ mediation agreement1 or a matter for the discretion of the mediator.

If the prescribed timeframe is coming to an end, a decision will have to be taken on whether to extend the mediation, adjourn the proceedings for a period and then return to discussions, or abandon the mediation altogether.
