40 Restrictions on land that may be compulsorily hired

Certain general restrictions are imposed by the legislation relating to allotments on the compulsory acquisition, whether by purchase or hiring, of particular categories of land1.

No land that is pasture land may be authorised by order to be compulsorily hired for allotments if it is proved, to the satisfaction of the Secretary of State or the Welsh Minister, that arable land equally suitable for allotments is reasonably available for hiring by the council2.
