123 Release of covenants

In addition to release by agreement there is also a procedure whereby a restrictive covenant can be discharged or modified by application to the Upper Tribunal (Lands Chamber) under the Law of Property Act 19251 because of changes of character in the neighbourhood, or because it has become obsolete. However, where the statutory jurisdiction to discharge or modify a covenant is exercised, the Lands Tribunal may direct the applicant to pay to any person entitled to the benefit of the restriction such sum by way of consideration as the Tribunal may think it just
