117 Party walls and fences

Walls or horizontal divisions between two adjacent properties in different ownership may be party walls or structures1.

The position regarding works to party walls is governed by the Party Wall etc Act 1996. This effectively extended the principles of legislation which had previously only applied in London2 and Bristol to the whole of England and Wales,. Essentially the Party Wall etc Act 1996 provides that any landowner (‘the building owner’) who wishes to build into a party wall, or carry out work or excavate within three metres of a party
