The following points should be noted:

  1. 103.1

        Any contract for sale of a garden, the grant of a lease for over three years of a garden or the grant of a legal easement to use land for a garden is a contract for the sale or other disposition of an interest in land governed by the Law of Property (Miscellaneous Provisions) Act 1989, and can only be made in writing and only by incorporating all the terms which the parties have expressly agreed in one document signed by the parties, or where exchange of contracts is involved
