77 Relation to partnerships

Although share farming agreements are regarded as a category of farming arrangements quite separate and distinct from that of general partnerships, it is sometimes difficult to justify the distinction or to show that a particular set of arrangements avoids falling within the very wide statutory definition of general partnership1. Share farming agreements can really only be distinguished from general partnerships if they are arrangements for sharing not in profits (ie gross receipts less expenses) but in gross returns2.
