70.5 Withdrawal of land from partnership use

The withdrawal of the land from use by the partners is governed by the provisions in the partnership agreement. It is usual to provide an agreed notice period to dissolve the partnership at the end of which the owners are entitled to recover exclusive possession of the land. The owners may also wish to include provision permitting withdrawal during the term of the agreement of part of the land from use by the partnership, for instance, if there is development potential.
