70.4 Compensation for enhanced value of land

In Faulks v Faulks1 Chadwick J recognised that the non-landowning partner may find assistance in the case of Pawsey v Armstrong2 in establishing a claim for monetary compensation where partnership money has been expended in maintaining or enhancing the value of land where such land is not owned by all partners. It may in these circumstances be just and equitable to make some allowance to the non-landowning partner.
