If a tenancy inadvertently arises and the strict requirements of the Agricultural Tenancies Act 1995 are not met, the tenancy is likely to constitute a business tenancy conferring security of tenure under the Landlord and Tenant Act 1954 Part II. Care must therefore still be taken to ensure that the basis of occupation for the partners is properly agreed and stated.
