A similar result can be obtained if the farm is kept outside the partnership and still, initially, in the ownership of the parents and simply made available to the partners on a shared occupation basis.

The points that must always be carefully considered where land is held outside a partnership are dealt with in detail in connection with the family farming partnership agreement1. There are further points that must be taken into account in the context of a family partnership where it is intended to make gifts of that land as well as of interests in the partnership.
