552 Removal of hedgerows generally

The removal of a hedgerow to which the Hedgerows Regulations 1997 Regulations apply is prohibited1 and any person who removes or permits another to remove a hedgerow is guilty of an offence2.

However, an owner or utility operator who wishes to remove a hedgerow can serve a notice of his proposal to remove it (‘hedgerow removal notice’)3 on a local planning authority.

The authority, after appropriate consultation4, can either give written notice that the hedgerow may be removed or serve a ‘hedgerow retention notice’ stating that work may not be carried
