504 Environmental Protection Act 1990

The Environmental Protection Act 1990 sets out a duty of care in relation to waste which applies to those who keep, treat or dispose of waste1. Everyone who has control of waste is required to take reasonable measures2:

  1. 504.1

        to prevent contravention by another person of waste management or permitting controls;

  2. 504.2

        to prevent escape of waste from his control or that of any other person; and

  3. 504.3

        on the transfer of waste, to ensure that the transfer is made to ‘an authorised person’ with a written description of the
