50–51    Dual use

Dual use occurs where two farmers use the same area of land to claim different subsidies under different schemes at the same time. An example would be where a landowner claims under an agri-environment scheme at the same time as a tenant under a farm business tenancy claims under the Basic Payment Scheme.

In England dual use was permitted under the Single Payment Scheme, although there were specific requirements with which the parties had to comply. Defra allowed dual use to continue for the 2015 Basic Payment Scheme year. From 2016 onwards Defra has confirmed in its guidance that
