403 The need for planning permission: generally

Planning permission is required where any development1 is proposed. Development comprises two alternative elements:

  1. 403.1

        the carrying out of building, engineering, mining or other operations in, on, over or under land; or

  2. 403.2

        the making of any material change in the use of any buildings or other land.

For the reasons set out below, it is the first of these limbs that is generally of importance in the control of agricultural activities. The second limb generally assumes importance only when contemplating a change of use from an agricultural use to a non-agricultural
