4.4.4 Schemes avoiding security of tenure

Prior to 1 September 1995 and the introduction of the farm business tenancy regime, a variety of schemes evolved over the years with the aim of entitling landlords to recover vacant possession notwithstanding that the occupants of the land were granted what would appear to be tenancies protected by the Agricultural Holdings Act 19861. Such schemes should be examined with particular scrutiny as they will frequently come within the scope of the principles laid out by the House of Lords in Johnson v Moreton2 as being contrary to public policy
