4.4.1 General

Notwithstanding the advent of the farm business tenancy, it is still of vital importance for buyers, sellers and mortgagees of agricultural land to consider whether tenancies under the Agricultural Holdings Act 1986 exist at the time of sale or mortgage. An implied surrender of pre-existing 1986 Act tenancies may have been effected if landlord and tenant have, since 1 September 1995, entered into a new written tenancy agreement1. If there has not been such a surrender and the land has been farmed by the same person since before 1 September 1995, great care will be required
