259 Length of the agreement

Agreements under the Entry level Environmental Stewardship (ELS) scheme run for five years. Accordingly, if a farmer is unable to comply with his obligations under the agreement for the whole of the five year period in relation to the whole of the land he will be in breach of his agreement. Where a farmer knew at the outset that there was a prospect that he would not be able to comply with the obligations under the agreement for the full period, he should have either excluded the land from the agreement or asked the owner/incoming
