250 Penalties, offences and appeals

If a farmer breaches a Countryside Stewardship Scheme agreement, for instance by:

  1. 250.1

        claiming payments that are not due;

  2. 250.2

        failing to comply with the eligibility criteria;

  3. 250.3

        claiming for ineligible expenditure; or

  4. 250.4

        failing to meet cross-compliance requirements

and if this is identified by the relevant agency a penalty may be applied unless the farmer can show that force majeure or other exceptional circumstances apply1. This could include the withholding of any further payments due under the scheme agreement and the reclaiming of previous payments made2. The relevant agency can also terminate the scheme agreement
