25 Farmer

The applicant under the Basic Payment Scheme (and the recipient of any transfer of entitlements) must be a ‘farmer’ and an ‘active farmer’. A ‘farmer’ is defined as ‘a natural or legal person, or a group of natural or legal persons, whatever legal status is granted to the group and its members by national law, whose holding is situated within the territorial scope of the Treaties... and who exercises an agricultural activity’1. A ‘farmer’ can be an individual or a company and also a partnership. As between landlord and tenant, the tenant will be the ‘farmer’;
