191.2 Fishing—tidal waters

There is a prima facie public right of navigation over all tidal waters1. This is a free right of passage which cannot be limited otherwise than by or under Act of Parliament or (in particular cases) by proof of immemorial user2. The public have a right to fish in most tidal waters, subject to local byelaws and the Salmon and Freshwater Fisheries Act 1975.
