177 Criminal sanctions

Commission of any of the offences under the following sections of the Protection of Badgers Act 1992 is punishable on summary conviction by imprisonment for a term not exceeding six months or a fine not exceeding level 5 on the standard scale or both1:

  1. 177.1

        Section 1(1), (3)–taking, injuring and killing badgers;

  2. 177.2

        Section 2–cruelty;

  3. 177.3

        Section 3–interfering with badger setts.

A person guilty of an offence under the following is liable to a fine on summary conviction not exceeding level 5 on the standard scale2:

  1. 177.4

        Section 4–selling and possession of live badgers;

  2. 177.5
