152 Establishment

A local nature reserve is established by declaration of the local authority1 following consultation with Natural England and the Natural Resources Body for Wales (as applicable)2. Failure to consult before declaration may invalidate the declaration and any powers exercised by the local authority pursuant to it, notably in the enforcement of byelaws under Section 20 of the National Parks and Access to the Countryside Act 19493.

The declaration is made under Section 19 of the 1949 Act and is conclusive of the fact that the land is to be managed as a nature
