121 Criminal sanctions

A person1 who, without reasonable excuse, carries out an operation specified in the notification other than in accordance with the provisions of Section 28E(1) of the Wildlife and Countryside Act 1981 is liable on summary conviction to a fine not exceeding £20,000 or on conviction on indictment to a fine1. It is a reasonable excuse to carry out an operation (or to fail to comply with a requirement to send a notice about it) if2:

  1. 121.1

        the operation was authorised by planning permission granted on an application under the Town and Country Planning Act 1990 Part III
