100.2 Fitness for purpose

There is no implied condition as to the fitness of an animal for any particular purpose except where the seller carries on a business of selling such animals and this will apply only where the buyer, expressly or by implication, has made known to the seller that particular purpose so as to show that he relies on the seller’s skill or judgement1. Otherwise there are no warranties whatever upon the sale of an animal as to its quality or fitness for any particular purpose in the absence of express provision in the contract, and
