77–100    Title matters

The landlord’s freehold title to a holding should be checked for covenants, easements, mortgages and any other restrictions1. Where appropriate, additional tenant’s covenants should be included in the tenancy agreement to cover compliance with such matters. Where necessary, the consent of any mortgagee or other third party should be obtained to the grant of the tenancy.
