51 Tenant’s right to compensation

Subject to compliance with the statutory requirements1, a tenant under a farm business tenancy is entitled, on quitting the holding on the termination of his tenancy, to obtain from his landlord compensation for any tenant’s improvement2. The tenant is entitled to compensation in accordance with these provisions ‘notwithstanding any agreement to the contrary’3. Before a tenant is entitled to compensation the tenancy must be terminated and the tenant must be quitting the holding.
