446 The rent assessment committee’s role

The tribunal or rent assessment committee must consider whether the tenant is paying rent ‘significantly higher’ than that payable under similar tenancies of similar dwellinghouses in the locality1. The tribunal or committee is required to fix the rent at the level it thinks the landlord might reasonably be expected to obtain under the assured shorthold tenancy in question2. The tribunal or committee cannot make a determination:

  1. 446.1

        unless it considers that there is a sufficient number of assured tenancies (whether shorthold or otherwise) of similar dwellinghouses in the locality3
