441 Post 28 February 1997 assured shorthold tenancies—the exceptions

The circumstances in which a tenancy which is an assured tenancy will not automatically take effect as an assured shorthold tenancy are:

  1. 441.1

        where the landlord has served on the tenant prior to the grant of the tenancy a notice that the tenancy is not to be an assured shorthold tenancy1;

  2. 441.2

        where the landlord has served notice on the tenant during the term of the tenancy that the tenancy is no longer to be an assured shorthold tenancy2;

  3. 441.3

        where the tenancy agreement itself contains a statement that the tenancy
