411 Housing Act 1996—the transition to protection

The default position for tenancies granted on or after 28 February 1997 is that the tenancy will take effect as an assured shorthold tenancy as opposed to an assured tenancy1. It would appear that the same ‘statutory magic’ will occur, converting the tenancy into an assured agricultural occupancy upon the condition being fulfilled unless the landlord has served notice in the prescribed form on the tenant prior to the grant of the tenancy under the current legislation2.
