406 Agricultural worker condition

The agricultural worker condition is defined by reference to the definitions and qualifying criteria contained in the Rent (Agriculture) Act 19761. To qualify for protection the worker must establish that:

  1. 406.1

        the worker is, or has at any time during the subsistence of a relevant tenancy or a relevant licence2 been, a qualifying worker3; and

  2. 406.2

        the dwellinghouse is in qualifying ownership4.

The agricultural worker condition is also satisfied if the occupier is a widow, widower, civil partner or member of the family of a deceased qualifying worker, provided that:
