353 Enforcement of duty

Without prejudice to any other means of enforcing the authority’s duty to provide suitable alternative accommodation, that duty is enforceable at the suit of the applicant by an action against the authority for damages for breach of statutory duty1. However, the authority is not obliged to provide suitable alternative accommodation if the applicant retains the services of the occupier2.
