346 Case XII: dwellinghouse required as retirement home1

The court must make an order for possession against a protected occupier2 or statutory tenant3 where:

  1. 346.1

        the person who granted the tenancy or, as the case may be, the original tenancy (‘the owner’) acquired the dwellinghouse or any interest in it with a view to occupying it as his residence at such time as he should retire from regular employment4; and

  2. 346.2

        the court is satisfied that:

    1. 346.2.1

          the owner has retired from regular employment and requires the dwellinghouse as his residence, or

    2. 346.2.2.
