342 Case VIII: unlawful assignment1The court has discretionary power2 to make an order for possession against a protected occupier3 or statutory tenant4 where the tenant has assigned, sub-let or parted with possession of all or part of the dwelling house without the landlord’s consent5. This case does not apply if the assignment, subletting or parting with possession was effected before the Rent (Agriculture) Act 1976 came into force6.
