337 Case III: rent unpaid1

The court has discretionary power2 to make an order for possession against a protected occupier3 or statutory tenant4 where:

  1. 337.1

        rent lawfully due from the tenant has not been paid or

  2. 337.2

        any other lawful obligation of the tenancy, whether it is a statutory obligation or not, has been broken or has not been performed.
