317 Security of a tenant by succession

A statutory tenancy by succession devolving upon a surviving spouse or civil partner is fully protected by the Rent (Agriculture) Act 1976, enjoying the same security of tenure1, rent control2 and statutory terms3 as the original occupier. A statutory tenancy by succession devolving upon a member of the deceased’s family is an assured tenancy under the Housing Act 19884. Accordingly the security of tenure enjoyed by the member of the deceased’s family acquiring a statutory tenancy by succession on or after 15 January 1989 is that available
