308 Qualifying ownership

A dwellinghouse in relation to which the occupier has a licence or tenancy is in qualifying ownership at any time if, at that time, the occupier is employed in agriculture1 and the occupier’s employer2 either:

  1. 308.1

        is the owner3 of the dwellinghouse4; or

  2. 308.2

        has made arrangements with the owner of the dwellinghouse for it to be used as housing accommodation for persons employed by him in agriculture5.
