263 Appointment of a third party

Parties who wish to refer a matter for third party determination under the Deregulation Act 2015 must jointly appoint a third party to determine the matter1. The parties may not jointly appoint a third party to determine a dispute once an arbitrator has been appointed to determine the matter2. Once an appointment of a third party has been made, following a joint application by the parties, the matter in question shall be treated as having been referred for third party determination under the Agricultural Holdings Act 19863.
