253 Agreement, arbitration or third party determination

Whether a claim is made by the landlord or the tenant, they may during the process settle the claim. If they are unable to do so, they can jointly refer the matter to a third party for determination. Alternatively, after the period of eight months from the termination1 of the tenancy has expired, the parties can jointly appoint an arbitrator or either party can apply to the President of the Royal Institution of Chartered Surveyors for the appointment of an arbitrator to determine the claim2.
