244 ‘Evesham custom’

In any direction given by the tribunal1 that the provisions as to improvements to market gardens are to apply to a holding2 there are incorporated the terms of the so-called ‘Evesham custom’3. In accordance with this custom, where a tenancy is terminated by a notice to quit given by the tenant or by reason of the tenant’s insolvency4, the tenant is not entitled to any compensation in respect of improvements specified in the direction unless he satisfies certain conditions5. The conditions are that:
