(b) Direction that holding is to be treated as a market garden

243 Application for direction

Where the tenant of an agricultural holding desires1 to make on the holding (or any part of it) an improvement of the kind specified in the Agricultural Holdings Act 1986 Schedule 102 and the landlord refuses, or fails within a reasonable time, to agree in writing that the holding (or that part of it) is to be treated as a market garden, the tenant may apply to the First-tier Tribunal (Property Chamber) (in relation to England) or the Agricultural Land Tribunal
