206 ‘Greater hardship’ qualification

If the tribunal1 determine that the nominated successor is a suitable person to become the tenant of the holding, the tribunal must give a direction entitling him to a tenancy of the holding2. However, no such direction is to be given if it appears to the tribunal that greater hardship would be caused by giving the direction than by refusing the nominated successor’s application3.
