202 Exclusion where there is a notice to quit

An otherwise eligible person may not make an application for a direction entitling him to a tenancy of the holding if, on the date of the giving of the retirement notice, the tenancy is the subject of a valid notice to quit, given before that date and including a statement that it is given for any such reason as is referred to in Case B, D or E1, unless:

  1. 202.1

        it is determined by arbitration that the notice is ineffective on account of the invalidity of the reason
