At the date of the giving of the notice to quit, the tenant had failed to comply with a written notice served on him by the landlord being either:

  1. 180.1

        a notice2 requiring him, within two months from the service of the notice, to pay any rent due in respect of the agricultural holding to which the notice relates3; or

  2. 180.2

        a notice4 requiring him, within a reasonable period5 specified in the notice, to remedy any breach by the tenant (that was capable of being remedied) of any term or
